General terms and conditions of business

Responsible for Wisho Transport is Seegruppe GmbH

The General Terms and Conditions (GTC) govern the relationship between the customer and Seegruppe GmbH for transport and additional services. They constitute the complete agreement and replace all prior verbal and written agreements.

1. Our duties

Unsere Hauptpflicht besteht im Organisieren der angenommenen Aufträge. Wir sind verpflichtet, angenommene Aufträge vertragsgemäss und mit notwendiger Sorgfalt auszuführen. Reinigung: Falls nötig führen wir die Nachreinigung ohne zusätzliche Kosten durch. Darüber hinaus müssen wir bei Unkorrekthei t der Objektdaten den Vertrag  am Ausführungstag anpassen. Ansonsten besteht kein Anspruch auf Vertragsanpassung.

2. Obligations of the Customer

The customer must provide all necessary information for the order to be completed correctly. If there is a discrepancy between the information provided in the contract and the data determined on site, we reserve the right to charge an appropriate surcharge.

3. Prices

Die Preise werden entweder pauschal oder nach Aufwand berechnet. Dabei sind die Vereinbarungen im Vertrag verbindlich. Lageru ngen  werden den Kunden auf den ganzen Monat berechnet. Die Preise verstehen sich inklusive Mehrwertsteuer und in Schweizer Franken.

3.1 Prices

The price is calculated based on the amount of work required or as a flat rate. However, this does not include the following expenses unless otherwise agreed

1. Packing and unpacking of the removal goods, particularly for packaging work that must be carried out by the carrier on the day of the move
2. Special transport of packing materials and their rental or purchase
3. Dismantling and assembly of complex or new furniture that requires additional time or the expertise of a specialist
4. Transport of refrigerators or chests over 200 liters, pianos, grand pianos, safes, and other items weighing more than 100 kg

6. Additional costs for items that must be transported through windows or over balconies
7. transport insurance premiums; 8. Customs clearance, customs duties and customs fees; 9. Road taxes and ferry costs as well as official fees of all kinds; 10. Additional expenses for extra services provided in the interest of the move, even without a special order 11. Additional expenses due to weather conditions or if the transport vehicle cannot access the house due to closed or damaged roads, as well as for any waiting time of the transport vehicle and personnel for which the carrier is not responsible 12. Additionally, appropriate surcharges for transporting goods along long or unusual routes, unless these circumstances were explicitly included in the price agreement, as well as extra costs arising from detours if direct routes are blocked or inaccessible.

According to legal regulations, the removal and installation of lighting fixtures and other devices connected to the power grid must not be carried out by transport personnel.

4. Scope of cleaning services included in the flat rate.

Basic cleaning of the kitchen (including extractor, oven, refrigerator, kitchen cupboards, etc.), descaling, cleaning, disinfecting, and polishing of bathrooms and sanitary facilities, cleaning of joints, polishing of slatted blinds, window frames, curtain rails, window sills, and window panes (both inside and outside), cleaning of doors, door frames, door handles, built-in cupboards, strips, switches, sockets, radiators, floors, washing machine/tumble dryer, balcony, awning, cellar, screed, and mailbox.

4.1. Not included in the package price and to be paid separately are

Basic cleaning of the kitchen (including extractor, oven, refrigerator, kitchen cupboards, etc.), descaling, cleaning, disinfecting, and polishing of bathrooms and sanitary facilities, cleaning of joints, polishing of slatted blinds, window frames, curtain rails, window sills, and window panes (both inside and outside), cleaning of doors, door frames, door handles, built-in cupboards, strips, switches, sockets, radiators, floors, washing machine/tumble dryer, balcony, awning, cellar, screed, and mailbox.

5. Payment

The invoice amount must be paid in cash to the team leader on the day of the move (via payment slip), and only with the express consent of Seegruppe GmbH.

6. Insurance

Transport insurance: CHF 100,000 per move (can be increased if necessary). Business liability insurance: CHF 5,000,000, or coverage to protect against misuse by unauthorized persons, as well as to enforce breach of contract or terminate the contract immediately.

7. Withdrawal by the Client

In the event of any cancellation, justified or not, within 14 calendar days before the moving day, a penalty of CHF 500 will be charged.

8. Withdrawal of the Contractor

Our contractor may withdraw from the contract for organizational reasons up to one month before the agreed moving date. If this deadline is not met, the contractor will be responsible for any additional costs incurred.

9. Special Agreement

Special agreements must be documented in writing on the contract or offer. Any changes of ownership require mutual approval.

10. Liability

Seegruppe GmbH haftet nur für Schäden, die nachweislich durch Fahrlässigkeit des eigenen Personals verursacht worden sind. Unsere Firma haft et nur für Transportgut, dessen Verpackung den normalen Transportanforderungen entspr icht. So bedürfen zerbrechliche Gegenstände wie Lampen, Pflanzen und technische Geräte (Fernseher, Hi-Fi Geräte, Computer) einer geeigneten Verpackung. Bei Beschädigungen des Inhalts von Umzugskisten etc. hafte n wir nur, wenn das Ein- und Auspacken durch unsere eigenen oder von uns beauftragten Hilfspersonen bereitgestellt worden sind. Die Haftung  unsere r  Firma  beschränkt sich auf die Kosten einer allfälligen Reparatur oder einer Entschädigung für Wertminderung, unter Ausschluss j eglicher Ersatzansprüche. Die Haftung unserer Firma beginnt mit der Abnahme der Güter und endet mit dem Abladen am Bestimmungsort.

The customer is required to inspect the cargo immediately after unloading at the destination. Any obvious defects must be reported to the team leader right away and notified to Seegruppe GmbH in writing within 2 days. Failure to do so will void the warranty for these defects.

12. Data Protection

Seegruppe GmbH will adhere to the provisions of the Data Protection Act when handling personal data.

13. Validity

Diese allgemeinen Geschäftsbedingungen gelten ab Juli 2022 und behalten Gültigkeit bis zur Veröffentlichung einer neuen Version.

14. Place of jurisdiction

Der Gerichtsstand Schweiz ist Thun.BE. Anwendbar ist Schweizer Recht.
